Weardrop Terms of Use

These Terms of Use ("Terms") are an agreement between you and Weardrop A.Ş., Aznavurlar Mahallesi, Tax No: 111000 ("Weardrop", "we", "us"). Please read them carefully.

How we handle your personal data, including your photos, is explained in our Privacy Notice (weardrop.app/en/privacy). Processing your photo for a try-on requires your separate Explicit Consent (weardrop.app/en/consent), which you can refuse or withdraw; without it you can still visit the store, but you cannot use the try-on feature.

1. Summary (not a substitute for the full Terms)

• You must be 18 or older.
• Upload only photos of yourself. You are responsible for what you upload.
• The result is an AI-generated preview. It is not a guarantee of how a product looks, fits or feels.
• Weardrop is not the seller. Your purchase, delivery, returns and refunds are between you and the store.
• The store does not receive your photo or the generated image. We do not sell your photos and do not use them for advertising.
• Using the service against these Terms can lead to suspension.

2. Definitions

• Service: the Weardrop virtual try-on feature shown on participating stores' product pages (the "Widget"), the website weardrop.app, and customer accounts.
• Store: an online shop that has added the Widget to its website. Each Store is an independent business.
• Your Photo: any image you upload or select to use with the Service, including a photo saved to your account.
• Result: an image generated by the Service from Your Photo and a product picture.
• Account: a Weardrop customer account created with an email and password or with "Sign in with Google".

3. Acceptance and eligibility

3.1 You accept these Terms by ticking the acceptance box in the Widget or on the website, or by creating an Account. If you do not accept them, do not use the Service.

3.2 You confirm that you are at least 18 years old and legally able to enter into this agreement. The Service is not intended for, and must not be used by, anyone under 18. If we learn that a user is under 18, we will delete the related photos and Results and close the Account.

3.3 If you use the Service on behalf of someone else, you may only do so with that person's prior, informed and freely given agreement and only if that person is 18 or older (see section 5).

4. The Service

4.1 You select a product picture on a Store's page and upload or choose Your Photo. The Service sends Your Photo and the product picture to an artificial intelligence image generation service and shows you the Result.

4.2 The Service is offered free of charge to shoppers. Stores may pay us for providing it on their websites.

4.3 We may limit how many try-ons can be made, for example per person, per device, per internet connection, per day or per Store, to prevent abuse and control costs. When a limit is reached the Service may stop working until the limit resets.

4.4 We may change, suspend or discontinue the Service, or its availability on a particular Store, at any time. A Store may also remove the Widget from its website.

4.5 Some features require an Account, such as saving Your Photo for later and seeing your try-on history.

5. Your Photos: your responsibility

5.1 You are solely responsible for Your Photos. By uploading a photo, you confirm and guarantee that:

• it shows you, or a person aged 18 or older who has given you prior, informed and freely given permission to upload it for this purpose;
• you have all rights needed to upload it and to allow us to process it as described in these Terms and the Privacy Notice, and doing so does not breach anyone's rights (including privacy, personality, image and copyright rights) or any law;
• it does not show anyone under 18.

5.2 You must not upload images that:

• show minors, nudity or sexual content, or are sexually suggestive;
• show violence, weapons used to threaten, self-harm, hate symbols, or are discriminatory, harassing or defamatory;
• show other people (including in the background) who have not agreed to it;
• contain identity documents, payment cards, health information or other sensitive information;
• infringe copyright, trademarks or other rights, or are unlawful in any other way.

5.3 You must not use the Service or Results to impersonate anyone, to create misleading, deceptive or fake content about a real person, to harass, blackmail or humiliate anyone, to create sexual content, or for any unlawful purpose.

5.4 Choose a photo you are comfortable having processed by an AI service. Crop out anything you do not want processed.

5.5 If you upload a photo in breach of this section, you are responsible for the consequences, including claims by the persons concerned or by rights holders, and you agree to compensate us for the losses, fines and reasonable costs we suffer as a result, to the extent permitted by law.

5.6 Every photo, product picture and Result is checked automatically before and after generation. Photos that may show a person under 18, nudity or sexual content, more than one person, or products such as lingerie, swimwear or children's items are refused and not stored. We may also refuse, block or delete any photo or Result, and suspend or close your access, if we reasonably believe it breaches these Terms or the law. Where the law requires it, we will report unlawful content to the competent authorities.

6. AI Results are previews, not guarantees

6.1 Results are created automatically by artificial intelligence. They are illustrative previews only. They may not accurately show the product's colour, pattern, material, texture, size, fit, length, drape or proportions, or your own body, face or skin tone. They may contain errors, distortions or details that do not exist.

6.2 Do not rely on a Result when deciding to buy. Always check the Store's product description, size guide, measurements, materials and photos. Ask the Store if you are unsure.

6.3 A Result is not a statement, promise or warranty by Weardrop or by the Store about the product.

6.4 Results are shown with a notice that they are AI-generated. Do not present a Result as a real photograph.

7. Purchases are between you and the Store

7.1 Weardrop does not sell, deliver or guarantee products, does not take payments and is not a party to any contract between you and a Store.

7.2 Product information, prices, availability, delivery, cancellation, returns, refunds and warranties are the Store's responsibility and are governed by the Store's terms and the law that applies to your purchase. Your statutory consumer rights against the Store are not affected by these Terms.

7.3 Weardrop is not responsible for a purchase decision you make, or for differences between a Result and the product you receive.

8. Accounts

8.1 Provide accurate information and keep your password confidential. You are responsible for activity under your Account. Tell us immediately at [email protected] if you suspect unauthorised use.

8.2 If you sign in on a Store's page, the Widget keeps a sign-in token in your browser on that Store's website for up to 30 days. Sign out or clear your browser data on shared devices.

8.3 You may stop using the Service at any time. You can remove your saved photo on your account page. To delete your Account or your try-on history, contact us at [email protected].

8.4 We may suspend or close an Account that breaches these Terms, that is used fraudulently, or that has been inactive for a long time (we will notify you first by email where possible).

9. Your rights in your content, and our licence

9.1 You keep all rights in Your Photo. You grant Weardrop a limited, non-exclusive, worldwide, royalty-free, non-transferable licence to store, copy, transmit and process Your Photo, only for providing the Service to you (generating Results, showing your history, saving your photo if you ask us to), for keeping the Service secure, and for complying with the law. The licence ends when Your Photo is deleted, subject to the deletion periods in the Privacy Notice.

9.2 We do not use Your Photos or Results for advertising, marketing, profiling, identifying you, facial recognition, or to train our own AI models, and we do not sell them.

9.3 You may use your Results for personal, non-commercial purposes, subject to the rights of the Store and of the product's brand owner in the product picture. Do not use Results commercially or to advertise a product without their permission.

9.4 The Service, the Widget, the Weardrop name and logo, and our software are owned by Weardrop or its licensors. Product pictures, brand names and Store content belong to the Stores and their licensors.

10. Acceptable use of the Service

You must not:

• use automated means (bots, scripts) to access the Service or to make try-ons, or try to bypass usage limits;
• interfere with, overload or attack the Service, the Stores' websites or our providers;
• reverse engineer, copy or resell the Service or the Widget, or use it to build a competing product;
• access accounts, data or systems you are not authorised to access;
• use the Service in breach of the usage policies of our AI providers (for example Google's Generative AI Prohibited Use Policy).

11. Privacy

Your personal data is processed as described in the Privacy Notice (weardrop.app/en/privacy). In short: Your Photo is used only to provide the Service; the Store does not receive it; it is sent to our AI and infrastructure service providers, who process it for us; it is deleted according to the retention periods stated there.

12. Availability and changes

The Service is provided "as is" and "as available". We do not promise that it will always be available, error-free, or that every Result will be generated. We may change features at any time.

13. Liability

13.1 Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, in particular liability for intent or gross negligence, for death or personal injury, or your mandatory rights as a consumer or as a data subject.

13.2 Subject to 13.1, and because the Service is provided to you free of charge:

• we are not liable for indirect or consequential losses, loss of profit, or losses arising from a purchase decision;
• we are not liable for content uploaded by users, for the products, services or websites of Stores, or for interruptions caused by events beyond our reasonable control (including failures of our providers, networks or power, attacks, and decisions of authorities);
• our total liability to you in connection with the Service is limited to the amount of loss that was reasonably foreseeable when you used the Service.

14. Suspension and termination

We may suspend or terminate your use of the Service with immediate effect if you breach these Terms, if required by law or an authority, or to protect the Service, other users or Stores. Sections 5.5, 9.3, 9.4, 13 and 16 survive termination.

15. Changes to these Terms

We may update these Terms. We will show the version and date at the top. For important changes we will ask you to accept the new version before you continue using the Service, and for Account holders we will also notify you by email. Changes do not apply to try-ons made before they take effect.

16. Law and disputes

16.1 These Terms are governed by the laws of the Republic of Türkiye, without prejudice to mandatory consumer protection rules of the country where you live if they give you more protection.

16.2 Consumer disputes may be brought before the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) and Consumer Courts competent under Turkish law within the applicable monetary limits. Otherwise, the courts and enforcement offices of İstanbul are competent, without prejudice to your right as a consumer to bring proceedings where you live.
